This Fair Use Policy governs the acceptable use of the JKD Stinger Launch Monitor application (the "App"), the JKD Stinger Tech website (the "Site"), and any related services provided by JKD Stinger Tech ("we," "our," or "us"). This policy is designed to ensure a fair, safe, and positive experience for all users while protecting the integrity of our platform.

2. Permitted Use

The App and Site are intended for:

• Personal, non-commercial golf swing analysis and performance tracking
• Individual use by the registered account holder
• Recording and analysing your own golf swings in appropriate settings (driving ranges, golf courses, practice areas)
• Sharing your own swing data and results with coaches, playing partners, or on social media for personal use
• Accessing features appropriate to your subscription tier (Free or Pro)

3. Prohibited Use

You agree NOT to use the App or Site to:

3.1 Misuse of the Platform

• Share, sell, or transfer your account credentials to any other person
• Use a single account for multiple users simultaneously
• Attempt to circumvent subscription restrictions or access Pro features without a valid subscription
• Use automated scripts, bots, or tools to interact with the App or Site

3.2 Intellectual Property Violations

• Reverse engineer, decompile, or disassemble the App or any part of the service
• Copy, reproduce, or redistribute the App's algorithms, code, or proprietary technology
• Use JKD Stinger Tech's trademarks, logos, or branding without prior written permission
• Create derivative works based on the App without authorisation

3.3 Commercial Exploitation

• Use the App for commercial coaching services without a commercial licence agreement
• Resell access to the App or its features
• Use App data or outputs to build competing products or services

3.4 Harmful or Illegal Activity

• Record or analyse individuals without their knowledge or consent
• Use the App in any manner that violates applicable laws or regulations
• Attempt to gain unauthorised access to our systems or other users' accounts
• Transmit malware, viruses, or other harmful code
• Engage in any activity that disrupts or interferes with our services

4. Subscription Fair Use

Our subscription plans are designed for individual personal use. The following guidelines apply:

• Free Plan: Limited to the features described in the pricing section. Attempting to access Pro features on a Free plan is a violation of this policy.
• Pro Plan: Intended for one individual user. Family or group use requires separate accounts.
• Data Storage: Swing recordings are stored locally on your device. Cloud backup features (when available) are subject to reasonable storage limits.
• API Access: If API access is granted, it must not be used to scrape data at scale or for purposes outside your personal use.

5. Content Standards

If you share content through the App (such as swing videos or performance data), you are responsible for ensuring that content does not infringe on the rights of others, does not contain offensive or inappropriate material, and complies with all applicable laws.

6. Enforcement

We reserve the right to investigate suspected violations of this Fair Use Policy. Upon finding a violation, we may take any of the following actions, at our sole discretion:

• Issue a warning to the account holder
• Temporarily suspend access to the App or specific features
• Permanently terminate the account without refund
• Pursue legal action for serious violations
• Report illegal activity to appropriate law enforcement authorities

8. Disclaimer of Accuracy

The JKD Stinger Launch Monitor provides swing metric estimates derived from device sensors and computer vision algorithms. These metrics are intended for personal improvement and practice purposes only. They are not guaranteed to be accurate to professional launch monitor standards and should not be used for official competition, handicap submission, or any purpose requiring certified accuracy. JKD Stinger Tech makes no warranty regarding the precision of any metric output.

We may update this Fair Use Policy from time to time to reflect changes in our services or applicable laws. We will notify you of material changes by posting the updated policy on this page. Continued use of the App after such changes constitutes your acceptance of the revised policy.
